Newsletter Terms and Conditions

§ 1

GENERAL PROVISIONS

  1. These Terms and Conditions [the "Newsletter Regulations"] define the detailed rules for the provision of the free Newsletter service and govern the relationship between THE FUTURE IS HERS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered seat in Warsaw, address: ul. Śląska 47a/13, 70-431 Szczecin, Poland, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register under KRS number: 0000909235, NIP: 5223205486, REGON: 38934224, with a share capital of PLN 20,000.00, as the Service Provider, and the Subscriber.

  2. The Newsletter service includes sending:

    • a) educational content, information about new blog posts, materials shared on social media, discounts, current promotions, bonuses, events, challenges, trainings, and other marketing and commercial information regarding products and services offered or recommended by the Service Provider;

    • b) additional commercial information, sent to the electronic communication channels selected by the Service Recipient (email, optionally mobile phone) in the form of emails containing personalized offers or discounts tailored to the Service Recipient's interests and preferences, but not significantly affecting their decisions. This information is created based on personal data provided by the Service Recipient as part of using the Service Provider's services, including through registration forms for webinars, purchases, or registration on the Service Provider's Website, as well as participation in trainings, loyalty programs, downloading digital materials, or other interactions related to services provided electronically by the Service Provider.

  3. The legal basis for sending the information referred to in paragraph 2(b) is:

    • a) Article 6(1)(a) of the GDPR – consent of the data subject;

    • b) Article 398 in conjunction with Article 400 of the PKE Act – consent to receive commercial information via electronic communication means.

  4. By subscribing to the Newsletter, the Subscriber grants the Service Provider consent to process the Subscriber's data, including their name and email address, for the purpose of sending the Newsletter in accordance with the terms specified in the Newsletter Regulations and the Privacy Policy available at: hibestie.eu.

  5. The Newsletter service is provided via MailerLite Limited, Ground Floor, 71 Lower Baggot Street, Dublin 2, D02 P593, Ireland.

  6. The Subscriber may withdraw from the free Newsletter service at any time.

§ 2

ACCEPTANCE OF THE NEWSLETTER REGULATIONS AND DEFINITIONS

  1. Acceptance – in order to use the free Newsletter service, the Subscriber must accept these Regulations in full. If the Subscriber is unwilling or unable to accept these Regulations, they may not use the Newsletter service. The Subscriber confirms their commitment to comply with the Regulations by entering into an Agreement between themselves and the Service Provider.

  2. Capitalized terms used in these Regulations have the meanings set out below or defined directly in the text (in which case the defined terms are enclosed in quotation marks). The use of definitions makes the provisions of these Regulations more precise and concise.

    • "Subscription Form" – a form available on the Service Provider's Website that enables subscribing to the Newsletter service.

    • "Newsletter" – an electronically provided service delivered by the Service Provider to the Subscriber who has actively subscribed to the Subscriber list via the Subscription Form. As part of providing the Newsletter service, Materials are delivered.

    • "Materials" – data supplied and produced in the form of digital content, as defined in Article 2(5) of the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2024, item 1796, as amended), including, but not limited to, information made available in exchange for subscribing to the Newsletter.

    • "Subscriber" – a person possessing full legal capacity and the capacity to perform legal transactions (in the case of natural persons, an adult) to whom services may be provided electronically or with whom an Agreement may be concluded in accordance with the Regulations and applicable laws; if you represent a third party, the Client is not you, but the aforementioned party.

    • "ICT System" – a set of cooperating IT devices and software that enables the processing, storage, and transmission of data.

    • "Means of Electronic Communication (MEC)" – electronic devices enabling distance communication (e.g., email, SMS).

    • "Newsletter Regulations" – this document.

    • "Digital Content" – data produced and supplied in digital form, as defined in Article 2(5) of the Consumer Rights Act.

    • "PKE Act" – the Electronic Communications Law Act of July 12, 2024 (Journal of Laws of 2024, item 1221, as amended).

    • "Digital Service" – a service that allows the consumer to access data in digital form, as defined in Article 2(6) of the Consumer Rights Act.

    • "Technical Requirements" – means the minimum technical requirements necessary to use the Newsletter and enter into the Agreement, i.e., having a computer or other device connected to the Internet, equipped with one of the following web browsers (in the specified or newer versions):

      • Firefox 126.0.1,

      • Google Chrome 123.0.6312.94,

      • Safari 17.4.1,

      • Opera 110.0.5130.66,

        supporting JavaScript and enabling the storage of cookies. The Subscriber must have a valid and active email address, as well as a keyboard or other device allowing the correct filling in of electronic forms.

§ 3

GENERAL TERMS AND CONDITIONS OF USE

  1. The Newsletter service is available:

    • a) free of charge – by subscribing to the Newsletter via the form and providing the required personal data (email address, name, optionally phone number);

    • b) for a fee – by paying the amount of PLN 250 gross for access to digital content made available free of charge as part of the Newsletter. To make a purchase, contact the Service Provider at the email address: hello@hibestie.pl.

  2. The Newsletter service involves the receipt of notifications and materials corresponding to the nature of the Service Provider's business activities by the Subscriber who has provided the Service Provider with their email address.

  3. The provision of the service is for an indefinite period.

  4. The Subscriber is obliged in particular to provide the Service Provider exclusively with true, current, and necessary data, and to use the services offered by the Seller in accordance with applicable laws, accepted customs in this field, principles of social coexistence, and the provisions of the Newsletter Regulations.

  5. The Subscriber must possess a device and software that meet the following minimum technical requirements:

    • a) a device with Internet access (such as a computer, tablet, or smartphone) equipped with one of the up-to-date web browsers (Firefox version 126.0.1+, Chrome version 123.0.6312.94+, Safari version 17.4.1+, Opera version 110.0.5130.66+);

    • b) an active email address enabling the receipt of electronic messages;

    • c) software enabling the reading and processing of files in formats including:

      • PDF – software such as Adobe Reader or other compatible applications;

      • JPG, PNG – a built-in photo viewer in the operating system or external graphics software;

      • ZIP – decompression software such as WinRAR, 7-Zip, or built-in tools in Windows, macOS, or Linux operating systems;

      • DOC, DOCX (if applicable) – software such as Microsoft Office, LibreOffice, or compatible applications;

    • d) ensuring that the device has up-to-date operating system and application updates installed to guarantee compatibility with the transmitted materials.

  6. The Subscriber is responsible for providing a compatible device and software that enables the opening and processing of files delivered under the Newsletter.

  7. Using electronic services involves the transmission of data via the Internet, which carries risks characteristic of this network.

  8. The Service Provider applies technical, organizational, and legal measures to ensure data security.

  9. The Service Provider enables the Subscriber to conclude an agreement for the supply of digital content.

  10. To start using the service, fill out the subscription form and confirm it via the link in the email message.

  11. Subscribing signifies consent to receive commercial information and to use telecommunications terminal equipment for marketing purposes in accordance with applicable regulations, i.e., expressing consent to the use of telecommunications terminal equipment for marketing purposes pursuant to the PKE Act. These consents are voluntary, but necessary to use the Newsletter. The Subscriber may revoke them at any time.

  12. The Subscriber may unsubscribe from the Newsletter service at any time and without giving any reason. Cancellation can be submitted to the Service Provider:

    • a) in electronic form via an active link placed in the footer of every message sent as part of the Newsletter service, labeled "Unsubscribe" or a similar button;

    • b) via an email message to: hello@hibestie.pl.

  13. The Subscriber's use of the unsubscribe link, sending correspondence via email or traditional mail with a request to cancel the service, will result in the immediate termination of the contract for the provision of the Newsletter service.

  14. The Service Provider may discontinue the provision of the service by informing the Subscriber thereof.

  15. Withdrawal from the Agreement:

    • You may withdraw from the Agreement within 14 days from the date of conclusion of the agreement. To exercise the right of withdrawal, the Client should inform the Service Provider by means of an unequivocal statement, for example by sending an email or a letter to the address specified in the Regulations.

    • You may withdraw from the Agreement in the event of failure to supply digital content or a digital service.

§ 4

INTELLECTUAL PROPERTY

Exclusive rights to all elements, including works within the meaning of the Copyright and Related Rights Act of February 4, 1994 (Journal of Laws of 2022, item 2509, as amended), made available by the Service Provider, in particular copyrights, belong to the Service Provider or entities with which the Service Provider has concluded relevant agreements. The Subscriber has the right to use this content free of charge solely for their own personal use and for the proper use of the Newsletter service worldwide. Any other use of this content is permitted only on the basis of explicit, prior written consent granted by the authorized entity under pain of nullity.

§ 5

COMPLAINT PROCEDURE

  1. In the event of objections regarding the Newsletter service, the Subscriber may submit a complaint:

    • a) in an email message to: hello@hibestie.eu;

    • b) in paper form to the postal address:

  2. The complaint should contain the Subscriber's identifying details, a description of the issue, demands, and optional information regarding the circumstances, such as the type and date of the irregularity, as well as contact details.

  3. Complaints are considered within 14 calendar days. The response is provided in the same form in which the complaint was submitted, unless the Subscriber specifies another form.

  4. The Service Provider informs the Subscriber who is a Consumer about the possibility of using out-of-court procedures for handling complaints and pursuing claims. The rules of access to these procedures are available at the offices or on the websites of entities authorized to handle out-of-court disputes. These may include, in particular, consumer ombudsmen or Voivodeship Inspectorates of Trade Inspection, a list of which is available on the website of the Office of Competition and Consumer Protection.

  5. The Service Provider informs that an online dispute resolution system between consumers and traders at the EU level (ODR platform) is available at http://ec.europa.eu/consumers/odr/

§ 6

FINAL PROVISIONS

  1. The Service Provider reserves the right to amend the Newsletter Regulations in accordance with applicable laws.

  2. Amendments do not apply to agreements concluded before their entry into force; the Regulations in effect on the date of conclusion of the agreement shall apply.

  3. In the case of the Newsletter service, the Service Provider shall inform the Subscriber of the proposed changes to the Newsletter Regulations, the date the changes come into force, and the consolidated text of the amended Newsletter Regulations via the email address provided during the subscription process.

  4. The Subscriber may, prior to the entry into force of the amendments, submit a statement of non-acceptance of the changes, which is equivalent to resigning from the Newsletter service.

  5. In the case of continuous contracts, such as the Newsletter, amendments enter into force if the Subscriber does not terminate the contract within 14 days of notification.

  6. Disputes arising from the performance of this agreement shall be settled amicably, and if this does not resolve the dispute, the competent court shall be the common court having jurisdiction over the Service Provider's registered seat.

  7. The Regulations enter into force on: February 26, 2025.
